Competition terms and conditions

Orchard may run competitions from time to time. By submitting an entry to a competition, you agree to be bound by these terms and conditions.

1. Competitions

Orchard Information Systems Limited of 3rd Floor, Central Square, Forth Street, Newcastle upon Tyne, NE1 3PJ, England and its group companies in4systems Limited of the same registered address and Orchard Information Systems (Ireland) Limited of The Diamond, Donegal Town, Co. Donegal, Republic of Ireland (‘Orchard’) may run competitions from time to time. 

By submitting an entry to a competition, you agree to be bound by these terms and conditions.

2. How to enter

Orchard may run its competitions electronically, in person or by such other method as it may decide.

Each competition will run inclusively from the opening date and time confirmed by Orchard (the “Opening Date“) to the closing date and time also confirmed by Orchard (the “Closing Date“).

Orchard shall also confirm by the Opening Date how to enter the competition. Entries must be received by Orchard by no later than the Closing Date. All competition entries received after the Closing Date will be automatically disqualified.

Orchard will not accept:

(a)   responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b)   proof of posting or transmission as proof of receipt of entry to the competition.

3. Eligibility

For each competition, Orchard will confirm any eligibility requirements by the Opening Date.

Orchard’s employees, agents or suppliers who are professionally connected to a competition or its administration are not permitted to enter it, nor the members of their immediate families or households.

In entering a competition, you confirm that you are eligible to do so and eligible to claim any prize(s) you may win. Orchard may require you to provide proof that you are eligible to enter the competition.

Orchard will not accept competition entries that are:

(a)   automatically generated by computer;

(b)   completed by third parties or in bulk;

(c)   illegible, have been altered, reconstructed, forged or tampered with;

(d)   photocopies and not originals; or

(e)   incomplete.

Entries on behalf of another person will not be accepted and joint submissions are not allowed.

Orchard reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.

Competition entries cannot be returned.

4. The prize(s)

For each competition, the prize(s) shall be confirmed by Orchard prior to the Opening Date.

Prizes are subject to availability and there is no cash alternative.

Orchard reserves the right to replace a prize with an alternative prize of equal or higher value if circumstances beyond Orchard’s control makes it necessary to do so.

Prizes are not negotiable or transferable.

5. Winners

Orchard’s decision is final and no correspondence or discussion will be entered into.

Orchard will contact the winner as soon as practicable after the Closing Date, using the telephone number or email address provided with the competition entry. 

6. Claiming the prize

For each competition, details of how to claim the prize(s) shall be confirmed by Orchard prior to the Opening Date.

The prize may not be claimed by a third party on your behalf, unless otherwise agreed by Orchard.

Orchard will make reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within fourteen (14) calendar days of Orchard’s first contact, Orchard reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

Orchard does not accept any responsibility if you are not able to take up a prize.

7. Limitation of liability

Insofar as is permitted by law,  Orchard will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a prize except where it is caused by the negligence of Orchard or its employees. Your statutory rights are not affected.

8. Ownership

All competition entries and any accompanying material submitted to Orchard will become the property of Orchard on receipt and will not be returned.

9. Data protection

Orchard will only process your personal information in accordance with its Privacy Policy, which can be accessed on Orchard’s website.

10. General

If there is any reason to believe that there has been a breach of these terms and conditions, Orchard may, at its sole discretion, reserve the right to exclude you from participating in its competitions.

Orchard reserves the right to hold void, suspend, cancel, or amend any of its competitions where it becomes necessary to do so.

These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England.
